National Emergency

1. The National Emergencies Act of 1976 allows the president to issue an emergency declaration but only using powers that Congress has already approved, and the President has to declare what powers he's using.
2. Trump is trying to get around the power of the purse.
3. To pass a joint resolution, both houses would approve the resolution by a majority.
4. The president can veto the joint resolution, but it could be overridden by a 2/3 vote in both houses.
5. Landowners could potentially sue the president to stop the wall because their land could be seized through eminent domain.
6. Of the eminent domain lawsuits filed against President Bush, 60 to 70 of the 334 are still pending.
7. The ACLU say that it is an illegal declaration of a national emergency, unconstitutional, and hurting communities, so they could sue the president to stop the wall.
8. States could serve as a check on presidential power because they can also sue the president
