Supreme Court and Senate

1. If Brett Kavanaugh is approved, the earliest he could join the Supreme Court is October 8th.
2. The Supreme Court will continue to function normally with only eight judges, taking cases and voting on them as if everything is normal.
3. The issue with only having 8 judges is the possibility of a 4-4 vote on a case.
4. The court already has 23 scheduled cases.
5. There is an unofficial, unwritten rule that a judge does not vote on cases they were not present for, but he may choose to vote regardless, which has been done before.
6. There is a case coming to the Supreme Court about the constitutionality of capital punishment to someone who can not remember committing the crime due to repeated strokes on the basis of the 8th amendment.
7. In the case of a 4-4 vote, the lower court ruling remains in place.
